TERMS OF SERVICE for TRUCK LOAD MATCH at HardingerSystems.com This Agreement between HardingerSystems.com and the user (USER) is effective upon creating the account. USER ACKNOWLEDGES AND AGREES THAT USER HAS READ THESE TERMS AND CONDITIONS CAREFULLY, UNDERSTAND EACH OF THEM AND AGREES TO BE BOUND BY ALL OF THEM. By accepting these Terms and Conditions once, user agrees to be bound by them each and every time user uses our Site or otherwise interacts with us online. If user does not agree to these Terms and Conditions, user may not access or otherwise use our Site.

SERVICES PROVIDED USER is entitled to post trucks and/or loads, search for available loads and use any other freely offered services integrated within HardingerSystems.com.

MONTHLY FEES Until further notice there is absolutely no charge for these posting and searching accounts. HardingerSystems.com reserves the right to charge for it's service and should there be a need to charge at anypoint in the future, user has every right to discontinue use as no obligation what so ever.

DISCLAIMER USER agrees and understands the relationship of HardingerSystems.com to the USER is that of an information resource publisher. USER's relationship between any carrier, broker or shipper or any other member is separate from and independent of the USERs agreement with HardingerSystems.com. USER understands HardingerSystems.com does not intend or seek in any manner to participate in any relationship between the USER and any carrier, broker or shipper or any other member that arises out of the USERs use of HardingerSystems.com. Accordingly, USER agrees that HardingerSystems.com is not and will not be responsible or liable for, and USER agrees to hold harmless and indemnify HardingerSystems.com from and against any losses, claims, liabilities or expenses of any nature whatsoever incurred by USER, USER's company, or any shipper, broker, carrier or any other member or shipper's, broker's, carrier's or any other member's employees, agents or customers where such losses, claims liabilities or expenses pertain to a relationship between USERs and any shipper, broker, carrier or any other member arising out of the USERs use of HardingerSystems.com. Such claims in this paragraph include, without limitation, claims for damages caused by input of accurate, inaccurate or false information into HardingerSystems.com. USER also understands and agrees that HardingerSystems.com does not offer any representations or warranties, expressed or implied, including, without limitation, any representations or warranties as to (1) the willingness of any shipper, carrier, broker or any other member to use the USERs of HardingerSystems.com; (2) the accuracy of information or data entered into the HardingerSystems.com database; (3) the quality of the transportation provided by any carrier listed with HardingerSystems.com; (4) the compliance of any carrier with local, state or federal laws governing the carrier's business.

SITE USAGE Our site may use cookies to keep track of your session information. Our site's sign up form requires users to give us contact information (like their name and email address) and unique identifiers (like their MC and DOT numbers). We use Member contact information from the registration form to send the user information about our company and promotional material from some of our partners. The Member's contact information is also used to contact the Member when necessary, in some cases shared with our vendor partners who may want to contact our Members. Unique identifiers (such as MC and DOT numbers) are collected to verify the user's identity, for use in assigning account numbers in our Member system, and for other purposes. This site contains links to other sites. HardingerSystems.com is not responsible for the privacy practices, transactions or the content of such Web sites.

MILEAGE Our site displays the mileage of posted loads. If the broker/shipper supplies us with mileage then we will display the mileage with their loads. It is meant only to give you an estimate as to the distance between the starting and destination points of the load. HardingerSystems.com does not lay any claims to the accuracy of the mileage.

CANCELLATIONS Date of cancellation received by HardingerSystems.com ends agreement which will stop services after the point of cancellation. HardingerSystems.com reserves the right to allow accounts and, at its sole discretion, may cancel this agreement and discontinue service at any time. This Agreement shall be governed by the laws of the State of California and shall constitute the entire agreement between HardingerSystems.com and USER with respect to the covered services, superseding all prior agreements and understandings relating to the subject matter thereof.
